We respectfully seek clarification from the Court on a number of points arising from the listing of a hearing in circumstances where in our submission, such a hearing may no longer be necessary or appropriate. Sealed Order and the Quashing of the Original Decision We note that a sealed order has been made by the Court on 25th August 2025 quashing the decision notice granting planning permission dated 7th November 2025. We would be grateful if the Court could clarify why a hearing has been listed in circumstances where a sealed order containing the Court's determination already exists and has not been set aside, varied, or corrected pursuant to CPR 40.12 or otherwise. We respectfully submit that the sealed order represents the Court's concluded determination and takes effect from the date it was made pursuant to CPR 40.7. In the absence of any application to set aside or vary that order, it is unclear on what basis a further hearing has been listed. Consent of the Defendant and Interested Party We further draw the Court's attention to the fact that both the Defendant and the Interested Party have consented to the quashing of the original decision. Where all relevant parties are in agreement that the decision should be quashed, and a sealed order to that effect already exists, we respectfully question the necessity of listing the matter for a further hearing. We invite the Court to confirm whether the hearing can be vacated in light of this consensus. No Remaining Public Interest — Revised NPPF (2026) In addition, we submit that any purported public interest in the hearing proceeding has been neutralised by the publication of the revised National Planning Policy Framework (NPPF) (2026). The policy landscape against which the original decision was made has materially changed, and the revised NPPF means that the substantive planning issues underpinning these proceedings must now be reconsidered in any event. In those circumstances, there is no public interest that would be served by the hearing going ahead, and the continuation of the proceedings would represent a disproportionate use of the Court's resources. Unanswered Correspondence Finally, we note with concern that the Interested Party has sent a number of emails to the Court which remain unanswered. These include correspondence dated 3rd June 2026 and 29th July 2026. We respectfully request that the Court respond to the matters raised in that correspondence at the earliest opportunity, as the issues raised therein are directly relevant to the question of whether the listed hearing should proceed. Relief Sought In light of the above, we respectfully request that: 1.

The Court confirms whether the listed hearing remains necessary in circumstances where a sealed order for quashing already exists and the Defendant and Interested Party have consented;

AB 28 2. If the Court considers the hearing should proceed, the Court provides reasons for that decision; and 3. The consent order quashing the decision under challenge was approved on the papers on 25 August 2026 and sealed by the Court. That order has not been set aside, varied, or revoked by any judge. It remains a valid and enforceable order of the Court, and the decision has accordingly already been quashed. The administrative email of 8 September 2026 asking recipients to disregard the order has no legal effect: a sealed court order can only be corrected or set aside by judicial act under CPR 40.12, not by administrative correspondence. The substantive claim is therefore spent. The Claimant sought quashing, and quashing has been ordered. There is nothing for the hearing of 20 October 2026 to determine. The revised National Planning Policy Framework (2026) further removes any public interest in the hearing proceeding, as any redetermination will take place under a materially different policy framework. To the extent that the Claimant questions the procedure by which the hearing was vacated, we respectfully ask the Court to confirm whether the decision was made with judicial approval or, if it was not, to place the matter before a judge now for confirmation. Given the sealed order already in force, we are confident that any judge considering the position would confirm that there is no purpose in the hearing proceeding. We respectfully invite the Court to confirm that the hearing remains vacated. regards Amy

On the call, Fareeha Noor of the List Office asked the Claimant to set out its position by email for forwarding to the List Office manager. The Claimant asks for this to be dealt with URGENTLY today. 1. The Claimant did not sign the draft consent order. On 28 April 2026 the Defendant sent the Court a draft consent order signed by the Defendant and the Interested Party only. The Claimant did not sign it and does not agree to it, and said so in writing on 29 April 2026 (attached) and again on 10 May 2026. The Claimant's signature block on the draft is blank and its costs term reads "[TBC]". The Defendant's own letter of 28 April 2026 states: "It is acknowledged that there is no agreed final order before the Court, since the Claimant has refused to sign the Consent Order attached" (Core Hearing Bundle, CHB 111, paragraph 9). The Claimant objected to the draft in writing on nine occasions between 29 April and 30 July 2026 and on seven of them asked that its objection be placed before a Planning Court judge; no judge has ruled on it. The claim has not been settled. The Claimant wishes the hearing on 20 October 2026 to go ahead and lodged the hearing bundles on 22 September 2026 at 2.52 pm (submission 58081790085169795). 2. The order served on 26 August 2026 is that unsigned draft, approved on the papers on 25 August 2026. It recites that the three parties "are agreed as to the terms of this Order", which is not so, and it was not served on the Claimant. On 8 September 2026 the Paper Results team asked the recipients to disregard it "due to administrative error". The Paper Results team then wrote to the Interested Party's solicitor on 22 September 2026 at 3.37 pm that it "was served in error as the claimant had not consented to the terms in the order", that "the claimant still wishes for the hearing to go ahead", and that "a fully signed consent order may have to be agreed by you all so that the hearing can be vacated". No signed consent order exists.

3. At 4.37 pm the same day the List Office wrote to counsel, the Defendant and the Interested Party that the hearing "has now been vacated". That email names no judge, no order, no application and no reason. It did not go to the Claimant, which learned of it from counsel at 6.42 pm. The only request before the Court was the Interested Party's solicitor's email of 11.46 am inviting the Court "to confirm whether the hearing can be vacated", which was not copied to the Claimant either. On the telephone today the List Office said that the hearing "has been taken out from the list" and that whether a judge or an ACO lawyer decided it is being checked. No order vacating the hearing has been served on the Claimant. The Claimant believes the hearing was vacated in error, on the strength of a draft order that the Claimant never signed and that the Court has itself said was served in error. 4. The Claimant asks that the hearing be put back in the list for Tuesday 20 October 2026, the date fixed by the listing notice of 28 May 2026, and that the date not be released to another case. The Claimant is ready for that date: the bundles are lodged, the skeleton argument will be filed by 29 September 2026 under the order of Kimblin J, and counsel is instructed. Kimblin J granted permission on all four grounds, found them "strongly arguable", and endorsed the order "This case is NOT suitable for hearing by a Deputy High Court Judge". A hearing may only be vacated by judicial order (Listing Policy, Annex 4 to the Administrative Court Judicial Review Guide 2025, paragraph 32). If any order was made, the Claimant asks for a copy today. 5. None of the Court's messages reached the Claimant. The Claimant is a litigant in person and conducts this claim itself. Counsel acts on a direct access basis as advocate only and does not conduct the litigation, and told the Court so again at 3.51 pm on 22 September 2026. The Court's emails of 26 August 2026, 8 September 2026 and 22 September 2026 (3.37 pm and 4.37 pm) went to counsel and not to the Claimant. The List Office said today that the Court's system holds counsel's email address and not the Claimant's. That is the wrong address. The Claimant wrote to the Paper Results team on 10 March 2026 (attached) asking that "all future communications are also sent directly to the Claimant" at residents@christslane.com, and the listing notice of 28 May 2026 was sent to that address. The Claimant asks that residents@christs-lane.com be recorded now as the Claimant's email address and that all correspondence in this claim be sent to it, with counsel copied. 6. The Claimant asks for a reply by email today confirming that the hearing has been put back in the list for Tuesday 20 October 2026. The Council fully endorses the email from the College (see below). In summary: 1. A Consent Order quashing the decision under challenge was signed by a Judge and sealed by the Court, thereby quashing the decision under challenge on 25 August 2026. A draft of that Order was sent to the Court (and the parties) with a cover letter dated 28 April 2026, explaining the position and inviting the Court to make the Order of its own motion. It is wholly unclear how an administrative email from the Court Office can revoke that Order (Emails dated 8 September and 22 September 2026 from the Court Office). There is no reference to any provision under which it is revoked. CPR 40.12 was not cited in the emails, and in any event deals with accidental slips or omissions in an order. 2. Since there remains a valid quashing Order, it is not clear what the substantive hearing on 20 October is intended to cover. Insofar as the Grounds related to the interpretation of the National Planning Policy Framework, the NPPF was updated on 17 August 2026. The Council is currently considering an identical application based on the new NPPF. It is doing so taking the cautious approach that the claim is still extant, whilst the position remains unclear for the reasons set out here. 3. The Council respectfully endorses the Interested Party’s request that the matter be placed before a Judge for confirmation of the position. We look forward to hearing from you. The first permission is quashed. The second is frozen.

On Tuesday 20 October 2026 the High Court quashed the first approval, 25/02161/FUL, on all four grounds of our claim. The Secretary of State has frozen the permission. On 13 October she directed the Council not to grant it without her authorisation while she considers whether to call the application in, six days after the identical application 26/02109/FUL was controversially approved. If you would like to support a call in, write to us and we will tell you how.
